Este ensayo, motivado por una crítica de Riccardo Guastini, ilustra el papel de la lógica en el derecho y precisamente: a) en la construcción de la teoría del derecho, b) en el razonamiento y en los discursos desarrollados por las disciplinas jurídicas positivas y c) en los razonamientos y en las operaciones de operadores jurídicos y en particular de los jueces.

In Amerindian ontologies, hallucinations or visions, rather than being dismissed as delusions or symbolic constructs, are recognized as means of perceptual access to physical reality. Lowland South American shamans claim to be able to diagnose and treat infectious diseases, and to assess the status of wildlife resources through interactions with pathogenic agents perceived in visions. This essay examines some perceptual capabilities that shamans might be employing to explore their physical reality. The structure of the eye affords a form of microscopy (...) of retinal structures and of objects flowing within them, including cells and microbial agents during systemic infection. Lowland South American shamanic practices involve optical and physiological conditions that optimize entoptic microscopy. Images of those visions display the characteristic features of shadow formation, confirming their microscopic origin. This phenomenological access to the microscopic world and similarities with the panorama depicted by current microbiology indicate the commensurability of these forms of knowledge. (shrink)

The Kiki-Bouba effect comprises a relation between two abstract figures and two non-words: the star-shaped figure is called 'Kiki' and the rounded figure 'Bouba'. The effect is explained by a sound-vision synaesthesia: certain sounds are associated with certain shapes in a non-arbitrary manner.When we asked the participants to decide which of the two figures, the star-shaped or the rounded one, to call yin and which yang, some 85% choose the star-shaped figure as yin. There are previous cases of synaesthesia where (...) personality is attributed to numbers or letters. In our results, the word Kiki is overall happy, clever, small, thin, young, unpleasant, and nervous. The starshaped figure is overall clever, tall, small, slim, nervous, unpleasant, and upper-class. That is, the correspondence above all concerns the qualifying adjectives clever, unpleasant, and nervous, as well as the physical appearance small and thin. This brings us to the fat-thin effect. Cinema, literature, comics, and children's programmes are full of contrasting figures: Don Quixote and Sancho Panza, Laurel and Hardy , Asterix and Obelix, Tintin and Captain Haddock, Bert and Ernie , or the Spanish comic about very naughty twin boys called Zipi and Zape . Our main conclusion is that first names and last names are not entirely arbitrary. There is a correspondence between names and physical characteristics and concepts . The Kiki-Bouba effect is a semantic one. (shrink)

In the wake of the most recent tragic school shootings in Florida and Texas, one must ask, when will enough be enough? Mass shootings have become an all-too-normal occurrence in contemporary society in our country. Although we are still impacted by every one of them, there is a concern that we are slowly becoming desensitized to the unspeakable actions of violence that are being carried out regularly. After the initial shock, the typical reaction to such actions involves a clichéd response (...) calling for thoughts and prayers, as if thoughts and prayers were enough to prevent the next incident every other time that people have called for them. B‐cell Acute Lymphoblastic Leukemia (B‐ALL) is the most common pediatric cancer, arising most often in children aged 2–5 years. This distinctive age distribution hints at an association between B‐ALL development and disrupted immune system function during a susceptible period during childhood, possibly triggered by early exposure to infection. While cure rates for childhood B‐ALL surpass 90% in high‐income nations, survivors suffer from diminished quality of life due to the side effects of treatment. Consequently, understanding the origins and evolution of B‐ALL, (...) and how to prevent this prevalent childhood cancer, is paramount to alleviate this substantial health burden. This article provides an overview of our current understanding of the etiology of childhood B‐ALL and explores how this knowledge can inform preventive strategies. (shrink)

This study aimed to determine the predictive character of organizational socialization and occupational positive mental health on organizational commitment in higher education teachers. A sample of 279 teachers from higher education institutions who signed an informed consent form was used. Fifty-four point five percent of the participants were women, with a mean age of 44.05 years. The participants completed the Organizational Socialization Inventory, the Positive Occupational Mental Health Questionnaire and the Organizational Commitment Scale, and for data analysis descriptive statistics, correlation (...) analysis and multiple linear regression with stepwise method were applied, entering each dimension of organizational commitment separately as a dependent variable. As a result, moderate to weak correlations were identified between the study variables, and it was found that the final models indicate that the future perspectives and socio-affective dimensions predict affective commitment by 38%; that future perspectives, spirituality and age predict normative commitment by 22.8%; and that the future perspectives dimension predicts commitment of continuity by 9.2%. It is concluded that teachers’ expectations about their development in the institution, as well as their interactions at the socio-affective and spiritual level with the work context, are factors that partially influence their attachment to the educational organization. Previous research has shown positive relationships between fitness level and different cognitive abilities and academic performance. The purpose of this study was to explore the relationships between logical–mathematical intelligence and mathematical competence with physical fitness in a group of pre-adolescents. Sixty-three children from Castro del Río, aged between 11 and 12 years, participated in this research. The Superior Logical Intelligence Test and the EVAMAT 1.0–5 battery were used. Physical fitness was evaluated by the horizontal jump test, the 4×10 meter speed–agility (...) test, and the Course Navette test. The analyses showed positive relationships between physical fitness with logical–mathematical intelligence and mathematical competence. Specifically, linear regression analyzes indicated that the 4×10 speed–agility test significantly predicted mathematical competence and the horizontal jump test significantly predicted logical–mathematical intelligence. These results are in agreement with previous research, highlighting the importance of improving physical fitness from an early age due to its benefits for intellectual and academic development. The organizational climate is the work environment conceived by emotions and motivation of an organization and, an optimal way of increasing participation is with working groups in the dependencies to improve: objectives, processes, conflicts, leadership. Thus the objective was to determine the characterization of variables. The method incorporates the quantitative approach, non -experimental design, descriptive level, applied and transversal type, analysis and deductive methods. The results show, there is a high organizational climate level, due to the contribution of three dimensions (...) or aspects that are: economic conditions, management values and organizational policies. In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. We show the simulation of the suggested regulator in two electricity generators. (shrink)

Resumo: Os escritos estéticos de Lukács durante a emigração na URSS constituem uma súmula de seu posicionamento contra o despotismo stalinista e a ortodoxia soviética. A despeito das “autocríticas protocolares”, os textos expressam a crítica interdita pelo dogmatismo e o sectarismo característicos do período e irão repercutir a preocupação do autor de que a Estética e Para uma Ontologia do Ser Social, fossem consideradas como sua contribuição à urgência da construção de um projeto de renovação e renascimento do marxismo.

O objetivo desse artigo é explicitar, na medida do possível, as críticas formuladas por Espinosa em relação a Descartes, notadamente em sua doutrina do livre-arbítrio. As críticas são fundamentadas nas proposições 48 e 49 da parte II da Ética, além das objeções que a complementam. Essa análise se deterá especialmente na identificação que Espinosa realiza entre ideia e volição, sendo a ideia concebida como um ato de afirmação ou negação, de modo que a volição é constitutiva da ideia. Com essa (...) análise, tentaremos evidenciar que a identidade entre ideia e volição não elimina o caráter voluntário da ação cognitiva do homem na filosofia espinosana. A crítica de Espinosa em relação ao conceito de vontade, entendida como uma faculdade abstrata, isto é um universal abstrato, visa a romper com a ideia de que a vontade é absolutamente livre. A vontade deixa de ser a faculdade que afirma a liberdade entre contrários e torna-se a afirmação da livre necessidade. É essa concepção de uma faculdade universal e abstrata que acarretará ilusão do livre-arbítrio. (shrink)

Trata-se de apresentar os caminhos de uma abordagem, cética em relação à política e seus mecanismos de sedução, bem como a sua imprevisibilidade.

Este artigo busca um diálogo entre a filosofia e a música, esta tratada mais como área do conhecimento do que como fenômeno estético ou social. Procurando uma superação da classificação de Boécio, que colocava o teórico como o terceiro e mais elevado tipo de músico – acima do instrumentista e do poeta –, notamos que a hermenêutica gadameriana impõe uma reunião do aspecto prático e teórico no âmbito da interpretação que acredito oferecer fundamento para uma epistemologia da interpretação musical. O (...) que a classificação boeciana perde de vista é que a música – como toda a proposição artística– é uma forma de pensamento. Gadamer vem aqui em nosso encontro através de seu livro Verdade e Método, um dos mais sólidos trabalhos em epistemologia do século XX, na medida em que determina a obra de arte “ ao lado da experiência da filosofia ”, como “a mais peremptória advertência à consciência científica, no sentido de reconhecer seus limites”. É nesta chave que desenvolvemos um modelo preliminar de constituição interpretativa, partindo do caráter universal da hermenêutica, proposto por Gadamer a partir do fenômeno da compreensão em sua concepção mais geral, Esse modelo precisaria ser, ao mesmo tempo, sistemático e aberto. E tem, ao mesmo tempo, implicações filosóficas sobre a atuação histórico-social do músico pesquisador. Em uma abordagem assim, justifica-se não só a presença da música enquanto disciplina da Universidade, mas também o fato – incômodo para alguns, especialmente ligados à tradição da musikwissenschaft – de essa presença assumir a herança do modelo conservatorial do aprendizado de ofício, não mais como uma tradição antiga e aceita, mas como um ponto de partida para novas proposições artísticas. This article aims to highlight the productivity of falsehood in the context of its asymmetrical position with truth. The core of the discussion can be summarized in the following statement: if only truths can be drawn from truths, it cannot be said that truth cannot be drawn from falsehood. The central thesis of the text is that the asymmetrical behavior of falsehood promotes the dissociation between the criterion (based on the conservation of truth) and the field of validity so that (...) the latter, broader than the former, incorporates the movement not only from truth to truth, but also from falsehood to falsehood and, above all, from falsehood to truth. The distinction between the symmetrical and asymmetrical fields allows understanding, for example, the emergence of certain logical fallacies, the separation between demonstration and deduction, the thesis of Popperian fallibilism, and the use of the hypothetical-deductive method. Truth does not have functions analogous to those of falsehood. (shrink)

Editou um livro com esse título, cujo sexto capítulo aborda o tema Fenomenologia e Educação. Mostrando invulgar erudição e fazendo a crítica de pensadores que reduzem a educação à adequação ou à revolta contra a sociedade industrial, Creusa Capalbo entende que o (...) papel da educação é o de propiciar a introdução de valores que assegurem a realização do bem comum. Inspira-se, para tanto, nas meditações exponenciais de Husserl, Scheler, Buber, dentre outros autores. La Suonata a 4 al Santo Sepolcro RV 130 e la Sinfonia al Santo Sepolcro RV 169, due composizioni gemelle risalenti con ogni probabilità agli anni Trenta del Settecento, occupano un posto singolare nella produzione strumentale di Antonio Vivaldi. L’indicazione del titolo «al Santo Sepolcro» non lascia dubbi sul fatto che le due partiture siano connesse con la Passione di Cristo e che dunque siano state composte per la settimana di Pasqua; restano tuttavia problematiche da individuare l’occasione e la destinazione (...) e per cui esse sono state scritte. Se da una parte appare chiaro il riferimento delle due composizioni al modello formale e stilistico rappresentato dalla sinfonia introduttiva del «sepolcro», il particolare tipo di oratorio coltivato dagli anni Sessanta del Seicento nella cappella imperiale di Vienna, dall’altra rimangono aperte le ipotesi di un adattamento di questo modello compositivo in funzione di un contesto diverso da quello viennese – o comunque centroeuropeo – e segnatamente di alcune possibili destinazioni in ambito veneziano. O objetivo deste artigo é analisar o conteúdo das Cartas 34, 35 e 36 da Correspondência de Espinosa a Hudde. Nele podemos perceber o esforço e engenhosidade do filósofo em conduzir o seu interlocutor a assentir à primeira definição da Ética, a definição de causa sui. Hudde, matemático de formação, se esforça em compreender como o filósofo pode demonstrar que a unicidade de Deus possa ser deduzida exclusivamente do fato de que sua natureza ou essência envolve existência necessária. É através (...) do estatuto causal da definição verdadeira que Espinosa poderá conduzi-lo, e evitar, assim, que caia nos paradoxos do uno e do múltiplo, da distinção real e da numérica. Dada a incapacidade do matemático em assentir à definição genética de Deus, o filósofo o conduzirá a assentir indiretamente à definição através do procedimento de demonstração negativa ou por redução ao absurdo. Esse movimento intelectual explicitará os propria de Deus: a eternidade, a simplicidade, a infinitude, a indivisibilidade, a perfeição e a unicidade. (shrink)

The reflections around teacher training and the means by which it is treated in the educational contexts have major importance, due to the urgency of the topic as well as the multiplicity of ways to be dealt along with the teachers. From researches of images production, developed with children and teachers in the ambit of early childhood education, this text will reflect on the formative processes of teachers in the childhood education. In this context, there are a few relevant questions: (...) what can the image do in the formative processes? In which ways may the teacher training help us to think about the childhood and the educational practices with little children? By which means may the childhood help us to think the work of teacher training. In this way, using the produced images, this text aims to operate in the circulation movement of the thought itself, in which the thought can, in its exteriority, experiment with words, childhood, image and teacher training, enabling ruptures to think about the child, the educators, the school, the knowledge, the doing, the powers, the action protocols, what to do with the children and how to deal with them, composing possibilities that overflow what is determined and legalized. As theoretical basis, we take authors such as G. Agamben, G. Deleuze e Michel Foucault. (shrink)

Jacopo Zabarella’s Opera Logica was published in Venice in 1578. It immediately gave rise to widespread discussion and argument before becoming a highly popular work not only in Italy but also, and above all, in central and northern Europe, in particular in the «reformed» Protestant universities. This essay is the first in a research into the doctrine of logic in Paduan philosophy, which has already rise to another, already published, study. It is the author’s intention to develop the latter further, (...) but in the meantime the theme discussed here is the «genus» of logic in question. It is a fundamental theme that Zabarella was the first to tackle. He began by asserting that the «definition of the thing» was so obscure that many men of letters, philosophers and logicians had ignored it. The very reason why he proposed to study the «proximate genus » of logic, which can be ascertained by examining the various forms of knowledge. This revealed the existence of five intellectual «habits»: science, prudence, art, intellect and erudition. Analysis of the «habits» and then the «concepts» and «names» enabled him to establish that logic was neither a «science» nor an «art» and certainly could not be confused with «dialectics». Its true nature, in fact, was that of an «instrument of science». This entailed acknowledging its «independence», though one conditioned by the Aristotelian distinction between the world of necessary and immutable «things» and that of human action and endeavour. The aim of this paper is to provide an appreciation of Michel Foucault’s The Order of Things reception, from the latest book by Ivan Domingues entitled “Foucault, a arqueologia e As palavras e as coisas: cinquenta anos depois” (Ed. UFMG, 2023). One of the scopes of the book is to examine the range of The Order of Things and its archaeological strategy to account for the presentation of the birth of human sciences, as well as its fragility and instability in (...) the face of a possible change in the disposition of knowledge. Or Episteme’s disposition, according to Foucault terminology, whose signs of change can be observed on the occasion of the advent, in the twentieth century, of Lacanian psychoanalysis, ethnology and structural linguistics. By privileging its repercussions, expansions and rectifications fifty years later, it is not intended to “correct” Foucault from an epistemological point of view, but to point out the fertility and power of his thoughts for posterity. It is about going through “fertile errors and anodyne truths” (DOMINGUES, 2020, p. 386). The bet is that possible gaps, errors or confusions identifiable by Foucault himself and by his critics at the time never invalidate the fertility of a discussion concerning human sciences, which were never the same after Foucault. Pretendemos desenvolver a tese, segundo a qual Stirner propõe uma concepção de liberdade como radical autorreferencialidade do estar junto a si, que se traduz numa posse de si mesmo. A despeito da crítica a Hegel, esse sentido de liberdade aproxima-se do conceito hegeliano de liberdade, mas de modo unilateral, abandonando o correlato da intersubjetividade na concepção de Hegel. Para Stirner, o egoísmo é decorrência daquilo que se tem de mais próprio: o eu. Somente assim o indivíduo chega ser ele mesmo (...) e reconhece essa sua condição como única — aquilo que lhe é próprio —, recusando qualquer outra determinação que se impõe acima dele mesmo, como uma impostura, um espectro que rouba sua própria identidade e, consequentemente, sua liberdade. O caráter comunitário da filosofia de Aristóteles resulta das diversas formas de análise da política que o filósofo apresenta na articulação dos seguintes aspectos: a tese de que o ser humano é um animal político; o modo como esta é realizada na comunidade política, na qual o logos se manifesta como atividade discursiva compartilhada; o cultivo de determinadas virtudes ético-políticas presentes na convivência humana, sobretudo, a amizade; a autossuficiência do cidadão e o seu vínculo com a autarquia da comunidade política. (...) A retomada de um moderno conceito de comunidade, na tentativa de reatualizar os princípios gerais do comunitarismo aristotélico, pode ser compatível com determinadas teses liberais, sobretudo a questão da liberdade (autonomia) individual e o fato do pluralismo ético e político nas sociedades modernas. The communal nature of Aristotle's philosophy results from the various forms of analysis of the politics the philosopher shows in the articulation of the following features: the thesis that man is a political animal; the way the political community is accomplished through this thesis, in which the logos itself manifests as a shared discoursive activity; the cultivation of certain ethical and political virtues present in the human companionship, above all, friendship; citizen self-sufficiency and its relationship with the autarchy of the political community. In an attempt to bring up to date the general principles of Aristotelian communitarianism, the resumption of a modern concept of community can be compatible with certain liberal theses, especially the issue of individual freedom (autonomy) and the fact of the ethical and political pluralism in the modern societies. O artigo que apresentamos tem a intenção de refletir sobre a vocação e missão dos leigos descritas no Documento de Medellín, dedica-se a um resgate das memórias que podemos colher, depois de 50 anos, mas, também, em atenção às novas perspectivas que o próprio documento nos traz, hoje. Medellín foi um marco importante para a história da Igreja da América Latina e voltar a esta conferência pode nos oferecer novas pistas e novos entendimentos para situações que vivemos hoje, tanto na (...) Igreja quanto na sociedade. Assim como o Concílio Vaticano II, Medellín foi importante para uma nova posição dos leigos na Igreja e para um novo entendimento de sua ação na sociedade, com autonomia e responsabilidades próprias. Neste artigo, daremos atenção ao Concílio Vaticano II e a sua recepção criativa em Medellín. Exploraremos aspectos do capítulo que trata exclusivamente dos leigos e, na sequência, discorreremos sobre algumas questões que o tema provoca e que, depois de 50 anos, mostram-se atuais e oferecem novos caminhos. Can a lonely long-distance run instantiate a meditation? Based on personal experience with running, I develop an affirmative answer to this question. First, I distinguish contemplation from meditation, proposing that the former is a non-reflexive activity focused on the monitoring of one’s own body, and that the latter is a reflexive activity that includes a “self” in memories of episodes from the personal past as well as in episodic counterfactual thoughts and in episodic future thinking. Next, I suggest that meditation, (...) by its characteristics, promotes a distancing from the sensorimotor contingencies of the present and that such detachment is dependent on our linguistic abilities. Finally, I question whether these remarks shed light into the debate about the embodied status of language. (shrink)

O presente artigo pretende compreender como o controle do tempo nas experiências migratórias de natureza forçada pode ser pensado como uma tecnologia biopolítica. Para isso, pretende-se resgatar o pensamento filosófico de Michel Foucault em torno da noção de governamentalidade, associando-o à análise de Benjamin Boudou sobre os limites temporais da hospitalidade, tendo como fio condutor a relação entre a regulação da circulação espacial do migrante e o problema do tempo de espera para ser acolhido. Além da distribuição espacial das populações (...) indesejáveis em campos de retenção como estratégia para tratar dos migrantes pobres e miseráveis, propõe-se uma reflexão crítica a respeito da espera por parte dos dispositivos de segurança, cujas restrições delimitam as fronteiras de uma comunidade política e democrática. Pretende-se oferecer aqui uma justificativa, tal como ela parece ter sido indicada por Platão no Teeteto, para o método de Sócrates, anunciado em Apologia como uma anthropíne sophía, capaz de avaliar os diferentes tipos de conhecimento. O recurso à imagem da maiêutica, no Teeteto, traz a representação de um aspecto desse método, posterior à refutação, em que o examinador ou parteiro elevam as opiniões do interlocutor até um princípio transcendente, para mostrar-lhes ou sua vacuidade ou sua solidez. Por fim, o (...) Diálogo de Platão parece não apenas representar o método de Sócrates, mas se inspirar nele para a composição do seu discurso, que joga com a forma de fazer ver e com aquilo que se vê a partir dele. The purpose of the article was to determine the relationship between the organizational culture and the institutional management of the "Enrique López Albújar" Educational Institution, Piura. Work is worked under a quantitative approach, descriptive and correlational scope, 40 teachers participated as a sample. Among the results, it was found that there is no significant relationship between organizational culture and institutional management, which did not allow validating the research hypothesis; However, a significant relationship between norms and customs with institutional management was (...) found; which concludes in compliance with the norms and good customs based on values.
